In certain circumstances the Deed of Transfers has conditions that do not allow encroachment upon the 2 meter servitude side space along the boundaries of the property, other than the street.
These cannot be removed by way of the Removal of Restrictions Act. Such applications are dealt with by means of doing a Deed of Encroachment.
Approval by council of such an application requires an attorney to register the Deed of Encroachment against the Deed of Transfer. This needs to be done in order to have any structure built within that servitude area.
